Terms of Service (For UK Consumers)

Section 1: General Conditions & Acceptance of Terms This website is operated by FURUGINME LLC (doing business as "MOOD"). By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"). These Terms apply to all users of the site. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

Section 2: Pricing and Payment Methods The selling price (including tax for domestic orders) is displayed on each individual product page.

  • International Orders: We accept Credit Card and PayPal. Payment is finalized at the time the order is confirmed.
  • Domestic Orders (Within Japan Only): We accept Credit Card, Convenience Store Payment (due within 2 days, 356 JPY fee), Bank Transfer (due within 7 days, fee borne by customer), Electronic Money (LINE Pay, PayPay, Merpay), Deferred Payment (Paidy), and Cash on Delivery (COD).

Section 3: Shipping, Customs Duties, and UK Import VAT Products will be shipped within 7 business days after the order or payment is confirmed (made-to-order products within one month).

  • Domestic Shipping: Free (excluding Hokkaido and Okinawa: 500 JPY).
  • International Shipping: Shipping fees are calculated at checkout. Please note that a different designated carrier will be used for international deliveries.

Important Notice for UK Deliveries: The displayed amounts (product price and shipping fee) do not include UK Import VAT (Value Added Tax), customs duties, or customs clearance fees. If such charges are levied by HM Revenue & Customs (HMRC) upon arrival in the UK, they are the sole responsibility of the customer (recipient). If you refuse to pay these taxes and the package is returned to us, you will be entirely responsible for all return international shipping costs and any incurred penalties, which will be deducted from your refund.

Section 4: Returns, Cancellations, and Statutory Rights If you are a consumer residing in the UK, nothing in these Terms affects your statutory rights.

  • Important Notes for Vintage Items: Because our products are pre-owned vintage items, there may be rare instances of stains or damages not explicitly stated. The actual color may differ slightly from the images due to lighting conditions, and slight manual measurement discrepancies may occur.
  • Your Right to Cancel (Cooling-off Period): Under the UK Consumer Contracts Regulations, you have the right to cancel your contract and return the item within 14 days of receiving the product without giving any reason. However, you must bear the direct cost of returning the goods internationally to Japan.
  • Faulty Goods: Under the UK Consumer Rights Act 2015, if your item is fundamentally defective or differs significantly from its description, you have a right to a full refund if you notify us within 30 days of receiving the product. In such cases, we will bear the return shipping costs.
  • Diminished Value: We may make a deduction from the reimbursement for loss in value of any goods supplied (e.g., if the product has been worn, altered, cleaned, acquired odors, or if original tags/accessories are missing), if the loss is the result of unnecessary handling by you.

Section 5: Intellectual Property All content included on this site, such as text, graphics, logos, images, and software, is the property of FURUGINME LLC or its content suppliers and is protected by international copyright laws. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from us.

Section 6: Limitation of Liability Except where prohibited by UK law (such as liability for death or personal injury caused by our negligence, or for fraud), to the fullest extent permitted by law, in no case shall FURUGINME LLC, our directors, officers, employees, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind, arising from your use of any of the service or any products procured using the service.

Section 7: Governing Law and Dispute Resolution These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Japan. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the district courts located in Tokyo, Japan. However, if you are a consumer resident in the UK, you will benefit from any mandatory provisions of the law of the country in which you are resident, and nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.
